Criminal Defense Investigations– A Criminal Defense Investigator is a crucial part of any Criminal Defense. Private Investigators can be assigned to cases as both a retained investigator and/or as a court-appointed-investigator (along with a court-appointed-attorney)
A Private Investigator can often go over a case and find new leads, find and interview witnesses that the Police never knew about, discover evidence, etc. It is always best to have a Private Investigator assigned to the case as soon as possible so that leads don’t go cold, witnesses forget facts or move away, or the possibility that evidence might be somehow destroyed.
If you find yourself charged with a criminal offense, be sure to ask your court–appointed attorney to have a Private Investigator assigned to the case. If you have a retained attorney (non-court–appointed), you should also discuss the benefit to having a Private Investigator hired on to go over the prosecutor’s case and evidence. You can hire a Private Investigator directly, but it’s always better to have the attorney hire the Investigator so that all work product is covered under the Attorney Client Privilege. You can still pay the Investigator directly, but have the attorney set up as the actual client.
The duty of a Criminal Defense Investigator is to follow the facts, make sure all leads were followed up on, and the Police made no mistakes in their investigation. Just as everyone is afforded the right to a defense attorney, everyone is afforded the right to a defense investigator. By providing the best defense possible to a defendant, this forces the Police and Prosecutor to do the best job in proving their case. This will in turn greatly diminish the possibility that an innocent person goes to jail or is convicted of a crime they didn’t commit.
